E-Bike Rental Agreement, Terms & Conditions, and Liability Waiver
PLEASE READ THIS RENTAL AGREEMENT CAREFULLY. YOU MUST AGREE TO ALL TERMS AND CONDITIONS IN THIS RENTAL AGREEMENT IN ORDER TO RENT AND OPERATE AN ELECTRIC BICYCLE FROM WILDWOOD CYCLES VA LLC. BY RENTING OR USING A BICYCLE, YOU AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT, INCLUDING THE LIABILITY WAIVER, RELEASE OF CLAIMS, INDEMNIFICATION, AND VOLUNTARY ASSUMPTION OF RISK PROVISIONS.
This Agreement (“Agreement”) is a legally binding agreement between Wildwood Cycles VA LLC (“Wildwood Cycles VA,” “Company,” “We,” “Us,” or “Our”) and the renter or rider (“You,” “Your,” or “User”).
This Agreement governs the rental and use of all bicycles, including pedal-assist electric bicycles (“E-Bikes”), accessories, and related services provided by Wildwood Cycles VA LLC.
1. Identification and Payment Requirements
To rent a bicycle, the renter must provide:
- A valid driver’s license
- A valid credit card
Wildwood Cycles VA LLC may retain payment information to cover damages, late fees, loss, or theft associated with the rental.
A security hold may be placed on the renter’s credit card for the duration of the rental period.
2. Rental Period and Fees
Rental periods and pricing will be communicated at the time of booking.
The renter agrees to:
- Return the bicycle within the agreed rental period
- Return the bicycle to the designated return location
- Return the bicycle directly to a representative of Wildwood Cycles VA LLC
Late returns may result in additional hourly or daily rental charges.
Failure to return the bicycle may be considered theft and reported to law enforcement.
3. Age Requirements
Riders must be at least 12 years of age.
Riders under 18 years old must be accompanied by a parent or legal guardian, and a parent or guardian must sign this agreement on their behalf.
4. Rider Ability and Physical Condition
Riding a bicycle or electric bicycle requires adequate physical condition, balance, coordination, and technical skill.
By signing this agreement, you confirm that:
- You are capable of safely operating a bicycle.
- You understand the operation of a pedal-assist electric bicycle.
- You assume responsibility for your own physical condition and ability to ride safely.
5. Pre-Ride Orientation
All riders must participate in a mandatory pre-ride orientation provided by Wildwood Cycles VA LLC.
The orientation includes:
- Bicycle operation instructions
- E-Bike safety guidelines
- Trail rules and etiquette
- Emergency procedures
Failure to follow these instructions may result in termination of the rental without refund.
6. Authorized Use Area
Wildwood Cycles VA LLC bicycles are intended for use primarily on the Mendota Trail and approved riding routes.
The renter will be informed of authorized riding areas before departure.
The following uses are strictly prohibited:
- Off-trail riding
- Jumping, racing, or stunt riding
- Riding on terrain unsuitable for bicycles
- Commercial use of the bicycle
- Subleasing or lending the bicycle to another person
7. Compliance with Laws and Trail Regulations
Riders must comply with all applicable:
- Federal laws
- Virginia traffic laws
- Trail regulations
- Land management agency rules
Some federal agencies restrict electric bicycle use to trails that allow motorized vehicles. Riders must obey all posted regulations.
Any tickets, citations, fines, or penalties received while operating a rented bicycle are the sole responsibility of the renter.
8. Prohibited Activities
You agree NOT to:
- Ride while under the influence of alcohol or drugs
- Allow another person to use the rented bicycle
- Carry passengers unless the bicycle is designed for that purpose
- Tow objects or trailers
- Modify or tamper with the bicycle
- Use handheld devices that interfere with safe operation
- Operate the bicycle in dangerous weather conditions
- Ride in a reckless or unsafe manner
Wildwood Cycles VA LLC reserves the right to refuse service or terminate a rental if unsafe behavior is observed.
9. Bicycle Inspection and Operation
Before riding, the renter must inspect the bicycle and ensure that:
- Tires are properly inflated
- Brakes function properly
- Seat and pedals are secure
- Battery is properly installed
- No visible damage is present
If a problem is discovered, the renter must notify Wildwood Cycles VA LLC immediately and must not ride the bicycle.
The renter agrees not to attempt repairs.
10. Helmets and Safety Equipment
All riders must wear appropriate safety equipment, Wildwood Cycles VA LLC provides access to helmets at the rental station if you do not have one.
Gloves and additional protective equipment are recommended but optional.
Failure to wear protective equipment increases the risk of injury and is done at the rider’s own risk.
11. Responsibility for Bicycle During Rental
The renter is fully responsible for the bicycle from the time it is rented until it is returned.
The renter assumes responsibility for:
- Damage to the bicycle
- Personal injury
- Damage to property
- Injuries caused to others
The renter agrees that Wildwood Cycles VA LLC is not responsible for injuries, accidents, or damages occurring during the rental period.
12. Bicycle Lock and Security
Each bicycle is equipped with a lock.
Whenever the bicycle is unattended, the renter must secure the bicycle using the provided lock.
If a bicycle is stolen, the renter must:
- Report the theft to local authorities immediately
- Provide Wildwood Cycles VA LLC with a copy of the police report
13. Damage, Loss, or Theft
The renter agrees to pay for all damage to the bicycle or missing equipment, including but not limited to:
- E-Bike
- Battery
- Helmets
- First Aid & Repair Kit
- Accessories
If the bicycle is lost, stolen, or not returned, the renter agrees to pay a replacement fee of $1,900.
If the bicycle is later recovered in acceptable condition, the replacement fee may be refunded.
14. Reporting Accidents or Damage
The renter must notify Wildwood Cycles VA LLC as soon as possible, but no later than 24 hours, if any of the following occur:
- Crash or accident
- Injury
- Bicycle damage
- Theft or loss
15. Assumption of Risk
Riding a bicycle or electric bicycle involves inherent risks, including but not limited to:
- Falls
- Collisions
- Mechanical failure
- Weather conditions
- Trail hazards
By renting and operating a bicycle, you voluntarily assume all risks associated with bicycle use.
16. Release of Liability
To the fullest extent permitted by law, you release and hold harmless Wildwood Cycles VA LLC, its owners, employees, affiliates, and agents from any liability for:
- Personal injury
- Property damage
- Loss
- Death
arising from or related to the use of the rented bicycle.
17. Indemnification
You agree to defend, indemnify, and hold harmless Wildwood Cycles VA LLC from any claims, damages, losses, liabilities, legal fees, or expenses arising from:
- Your use of the bicycle
- Your violation of this agreement
- Your violation of any laws or regulations
18. Limitation of Liability
To the maximum extent permitted by law, the total liability of Wildwood Cycles VA LLC for any claim related to bicycle rental or use shall not exceed $100.
19. Termination of Rental
Wildwood Cycles VA LLC may terminate a rental at any time if:
- The renter violates this agreement
- Unsafe behavior is observed
- The bicycle is misused
No refunds are guaranteed if a rental is terminated for violation of these terms.
20. Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Virginia.
21. Entire Agreement
This document represents the entire agreement between the renter and Wildwood Cycles VA LLC regarding bicycle rentals.
Wildwood Cycles VA LLC reserves the right to modify these terms at any time.
